CUSTOMER PRIVACY NOTICE
Pursuant to the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, hereinafter referred to as “The Law,” this privacy notice is issued under the following terms:
PERSON RESPONSIBLE FOR PERSONAL DATA
For the purposes of this privacy notice, Colinas , (trade name Villas Colina , hereinafter Villas Colina ) with address at Calle Hortencias 178, Alta Vista, Amapas 48399, Dep.101, Puerto Vallarta, Jalisco , is responsible for obtaining, disclosing, storing, using, handling, exploiting, transferring and/or disposing of, as well as protecting, the personal data it collects from its clients (hereinafter the Owners).
PERSONAL DATA COLLECTED
The personal data that Villas Colina collects from the Holders are, by way of example but not limited to, the following: Name, home address, email, age, date of birth, sex, marital status, nationality, telephone number, occupation, RFC, current employment data, copy of official identification with photograph, copy of proof of income, bank references, number of people who depend economically on him, among others.
Your personal data is collected via email or by providing documents proving the aforementioned data or through data transfers.
SENSITIVE DATA POLICY
DVillas Colina does not request any information that is considered sensitive data under the law, such as: religion, sexual preferences, political opinions, among others. The company supports and encourages diversity and therefore prohibits any discriminatory act or the request for any information that could imply a discriminatory act. In the event that you provide sensitive data, the company will treat and safeguard it in accordance with the law.
PURPOSE OF PROCESSING PERSONAL DATA
The data we collect is for the following purposes: (I) to prepare a service provision contract between Villas Colina and clients to establish the terms and conditions regarding the promotion of the property owned by the client (II) To prepare lease contracts, promise of sale, sale, transfer, investment projects on the properties promoted by Villas Colina (III) To carry out any management that allows confirming the legal status of the property promoted by Villas Colina (IV) To coordinate appointments with prospects at the address of the property owned by the client and promoted by Villas Colina (V) To exchange information and proposals between the prospect and the client related to the property promoted by Villas Colina (VI) To investigate the credit and legal integrity of the client (VII) In order to close all types of real estate transactions between the prospect and the client (VIII) To inform you of promotions, offers and launches (IX) To carry out marketing and prospecting activities, (X) To carry out statistical and market analysis, (XI) To invite you to events (XII) To keep our information up to date records.
Likewise, the personal data collected may also be used to meet legal requirements of competent authorities.
Villas Colina is not responsible for the truthfulness or accuracy of the data you have provided, nor has it verified it, but only receives, records and retains it. You also declare and confirm that you have the express consent of those persons whose personal information you provide, such as, for example: spouse, common-law partner, dependents, relatives, professional references, etc.
EXCEPTIONS
It should be noted that, pursuant to law, there are cases in which your consent is not necessary for the processing of your personal data, and therefore the absence of such consent or your refusal, where applicable, does not and will not prevent Villas Colina from processing them (your personal data) in terms of the law and other applicable regulations.
OPTIONS AND MEANS THAT Villas Colina OFFERS TO OWNERS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA.
The personal data of the Holders will be treated under the strictest confidentiality, taking into account the administrative, physical and technical security measures that Villas Colina implements in its internal security policies and procedures, avoiding the possible illicit disclosure of data and limiting its use to that established in this privacy notice.
MEANS TO EXERCISE THE RIGHTS OF THE OWNER
At any time, you or your duly accredited legal representative may exercise the rights of access and rectification when you consider that they are erroneous or inaccurate, cancellation if you consider that the data is not being treated appropriately and opposition if you do not want your data to be treated for specific purposes. The exercise of one of them does not prevent the exercise of the other and neither is a prerequisite for the exercise of the other.
To exercise your ARCO rights, you must submit your request to our address located at AVE. REVOLUCION 227B PITILLAL CENTRO, PUERTO VALLARTA, JALISCO or send it to our personal data department by email at osuna@maromma.com to the attention of the data protection department.
The request must contain the following information: (I) name of the owner (II) address and email address to notify the response to the request (III) a clear and precise description of the data in respect of which the corresponding right is sought to be exercised (IV) the objective of the request (V) any element that facilitates the location of the data and a copy of the identification must be attached, and where appropriate, the document by which legal representation is accredited.
The response period for your request will be 20 business days from the day on which the corresponding request for access, rectification, cancellation or opposition was received. The response will be communicated to you within the aforementioned period to the email address you provided in your request or by sending a letter to the address provided in it. Once said notification is received, you will have a period of 15 business days to make it effective if appropriate.
You may revoke at any time the consent you have given us for the processing of your personal data, so that we stop using them. To do so, you must submit a request under the terms mentioned for the exercise of ARCO rights. The procedure to follow will be the same as that provided for the exercise of ARCO rights. If your request is approved, your data will no longer be processed by Villas Colina.
DATA TRANSFERS
Your personal data may be transferred to national or foreign third parties if necessary to fulfill the obligations contracted due to the relationship with Villas Colina under the terms of section VII of article 37 of the law.
It is important to inform you that any third party that receives your personal data as a result of transfers made by Villas Colina will have the same obligations and responsibilities as us as those responsible for your data and that this privacy notice will be communicated to said third party.
CHANGES TO THE PRIVACY NOTICE
Any changes to this privacy notice will be notified to you through the following means:
By email that we will personally send to you.
And through advertisements in a visible place in the Villas Colina operational area .
Likewise, the Holders are informed that the privacy notice may be modified at any time in order to address legislative developments as well as modifications to Villas Colina ‘s internal policies .
If the purposes for which your personal data are processed are modified, your consent will be requested again, if necessary, either express or tacit, depending on the particular case.
